Nepal's e-commerce framework has moved beyond the bill described in the original 2024 article. The Electronic Commerce Act, 2081 is now listed by the Nepal Law Commission as enacted law.

Who should review the Act

Businesses selling through websites, apps, marketplaces or social-media channels should assess whether their activity falls within the Act and how their registration, disclosure, transaction and complaint processes must change.

  • Business and platform identification.
  • Clear product, service, price and delivery information.
  • Transparent order, payment, cancellation and return processes.
  • Consumer complaint and redress mechanisms.
  • Accurate advertising and protection of customer information.
  • Records that can demonstrate what was offered and agreed.

Social-media selling is not exempt

Using a social platform does not remove the need to comply with applicable e-commerce, consumer-protection, privacy, tax, registration and sector-specific rules. Sellers should separate personal accounts from business operations and provide customers with a reliable contracting and complaint channel.

Map the full customer journey – advertisement, product page, order, payment, delivery, return and complaint – against the authenticated Act and any implementing requirements. Penalties and procedures should be confirmed from the current official text before advice is given.
