Classification is not the whole test

Nice classes organize goods and services for administration. A shared class does not necessarily mean that all goods are identical or closely related, and different classes do not automatically eliminate confusion.

Practical implications

Assessment should consider the marks as a whole, the nature and purpose of the goods, trade channels, consumers, reputation and the evidence before the authority or court.
